Privacy Policy

This notice explains what personal data I collect through the gear list form on this site, why I collect it, how long I keep it, and the choices you have. It also covers the optional transfer of your data to Ducati West Europe, which only happens if you actively opt in.

1. Who is responsible for your data

The data controller for the personal data collected through this site's gear list form is:

  • Clement Lallemand, operating the website lallemandclement.com.
  • Contact for any privacy question or request: hello@lallemandclement.com
  • Based in Paris, France. A postal address can be provided on request to the email above.

I decide why and how your data is processed. If you opt in to the Ducati offer (see section 5), Ducati West Europe becomes an independent data controller for the data I transfer to them, for their own marketing purposes.

2. What data I collect

When you use the gear list form, I may collect the following, depending on how much you choose to fill in:

Consent recordsThe date and time you ticked each Ducati consent box, plus the consent version. Kept as proof of your consent.

I do not collect any data you do not enter yourself through this form. There is no hidden tracking of your gear choices, and the personalized list you build stays in your browser.

3. Why I collect it

I use your data for these purposes only:

  • To deliver the gear list and PDF. Your email is used to send you the personalized gear list, the full branded checklist PDF, and related follow-up emails from me (the 1-1-1 newsletter and occasional updates). You can unsubscribe at any time.
  • To pass you to Ducati, if you ask for it. If you open the optional Ducati block and tick the relevant box, I transfer your data to Ducati West Europe so they can invite you to test ride and send you their own commercial communications. This is entirely optional and separate from getting the gear list.

I do not sell your data. I do not use it for any purpose other than the ones listed above.

4. Legal basis

The legal basis for processing your data is your consent (Article 6(1)(a) of the GDPR), given freely, specifically, and unambiguously when you submit the form.

  • Submitting the form to get the gear list is your consent for me to email you the list and my newsletter.
  • Ticking the Ducati email box is a separate, specific consent to share your data with Ducati West Europe for their email marketing.
  • Ticking the Ducati phone box is a further separate, specific consent to be contacted by phone or SMS for marketing purposes.

You can withdraw any of these consents at any time (see section 9). Withdrawing consent does not affect the lawfulness of processing carried out before the withdrawal.

5. Sharing your data with Ducati

If, and only if, you open the optional Ducati block and tick the email-transfer box, I share the following data with Ducati so they can contact you: last name, first name, email address, and postal code. If you also tick the phone box, your phone number is included as well.

The recipient is:

Once your data reaches Ducati West Europe, they act as an independent data controller and process your data under their own privacy policy for their commercial communications and test-ride invitations. To exercise your rights against Ducati's processing, or to unsubscribe from their messages, you can contact me and I will pass it on, or contact Ducati directly using the unsubscribe link in their emails.

If you do not open the Ducati block, or you leave both Ducati boxes unticked, nothing is shared with Ducati. You still get your gear list.

This site and its forms are published in English. If anything in this notice is unclear, write to hello@lallemandclement.com and I will explain it in French or English before you decide.

6. Tools I use to process your data

I use Kit (formerly ConvertKit) as my email service provider. Kit stores your email and form data and sends the emails on my behalf, acting as a data processor under my instructions. Their use of your data is governed by their own data processing terms and privacy policy.

7. Where your data is stored

Kit (ConvertKit) is a United States-based company, so your data is stored and processed in the United States. Transfers of personal data outside the European Economic Area are covered by the appropriate safeguards required under the GDPR (such as the EU Standard Contractual Clauses) as set out in Kit's data processing agreement.

If you opt in to the Ducati transfer, your data is also processed by Ducati West Europe in France.

8. How long I keep it

I keep your data only as long as needed for the purposes above:

  • For my newsletter and gear list: until you unsubscribe or ask me to delete your data.
  • For data shared with Ducati and the related consent records: 3 years from our last contact, in line with the CNIL's recommended retention period for prospect data.

After the retention period, your data is deleted or anonymized. Consent proof records may be kept for the duration legally required to demonstrate compliance.

9. Your rights

Under the GDPR, you have the following rights over your personal data:

  • Access — ask for a copy of the data I hold about you.
  • Rectification — have inaccurate or incomplete data corrected.
  • Erasure — ask me to delete your data ("right to be forgotten").
  • Objection — object to the processing of your data for direct marketing.
  • Withdraw consent — withdraw any consent you gave, at any time, with no effect on processing done before the withdrawal.
  • Portability — receive your data in a structured, commonly used, machine-readable format, or have it sent to another controller where technically feasible.
  • Restriction — ask me to limit how I process your data in certain cases.

10. How to exercise your rights

To exercise any of these rights, email me at hello@lallemandclement.com. I will respond within one month.

You can unsubscribe from my emails at any time using the link at the bottom of every email I send. To stop Ducati's communications, use the unsubscribe link in their emails or contact me and I will relay your request.

11. Right to lodge a complaint

If you believe your data has been handled improperly, you have the right to lodge a complaint with the French data protection authority, the CNIL (Commission Nationale de l'Informatique et des Libertés):

You may also contact the supervisory authority of your own country of residence within the EEA.

12. Changes to this policy

I may update this policy from time to time. Any change will be posted on this page with an updated date at the top. If a change materially affects how your data is used, I will let you know by email where appropriate.
